and we worked through investigations to contact a person and were able to get it back. >> the blurred image on the right side of the cell phone video taken at the crime scene appears to be that gun. police say someone picked up the weapon from the crime scene. a weapon police recovered from a parole's home several days later turned out to be the wrong gun. now, saying there is no doubt they have the right one. >> now, we're happy that this tested positive to match the round retrieved by mr. harding. >> the 19-year-old was killed july 16th. police police say he fired on officers in the bay view. harding was a person of interest in a seattle murder. last week, investigators made the surprising announcement after getting ballistic test results on the fatal bullet. >> we believe that the fatal

wound on mr. harding's body was self inflicted. >> police believe harding accidentally shot himself after suffering a gunshot wound not toth leg during the shootout with officers. >> i'm angry and i'm hurt. i want the truth. >> harding's mother and other family members want the police to hand over evidence so they can reach their own conclusions. other activists want the same thing we'd have to be on an independent review panel just to see if that was the right gun. >> the chief says there is no gray area here. >> these are objective, fak wall scientific tests and they're lining up of the officers and witnesses to the event. >> there are four separate investigations going on in this case. the gun was a missing link. so the recovery of the gun will enhance the process. vic lee abc 7 news. >> thank you, vick. >> as police were announcing

they had found that gun from the bay view shooting, about two dozen people were gathered in front of city hall, protesting what they say is police harassment of young black men in the community. they're demanding the city establish a citizen's review board to investigate complaints against police. they want a community center and a law to prohibit discrimination. >> we don't have opportunities for jobs. dwont have opportunities for business loans. we don't have opportunities for contractors to get any work to give to our wem. -- people. >> a spokesperson says anyone not happy with an officer's conduct can file a complaint with office of citizen's complaints. >> one two of men accuse fd killing a woman and setting the body on fire was arraigned in an oakland courtroom today. hector garcia is charged with murder. he and another man are accused in the death of a 21-year-old monica rodas.

her mother was in court, demanding answers about her daughter's violent death. >> why couldn't they be compassionate of a 21-year-old pretty girl who trusted everyone to be her friend? why cruelty towards her? didn't they think they were born from a woman and a woman was young like her. >> they do not know yet the motive for this savage attack. >> a tragic story we told but yesterday, tonight has a tragic ending. the good samaritan shot in the head while feeding the homeless has died. we're live in oakland eastmont police substation. any new leads? >> as police have any new leads they're not saying but l there are a number of witness who's have come forward. sadly brother john was not expected to survive, he'd been clinging to life on life support, and he did die at 10:30 last night here in oakland. those with the least to give

everything. >> brother john's pregnant wife was grazed by a bullet, one daughter, shot in the arm. investigators still dmot have a motive for a crime that has left the police chief and mayor outraged. >> i'm hoping it was a mistaken identity. just random violence is not acceptable. >> i want to give a message. the message i want to give is that the oakland police department is coming. >> for the man left with many questions, he has an answer for those who keep asking. what did he do with that last meal from brother john? >> i ate it. that man gave his life to bring me that food. how could i disrespect him by not eating it?. >> we still don't know very much about who brother john was wex know he'd been feeding the homeless out in east oakland more than a year well. know that he ran a nonprofit here in oakland that helped the homeless and victims of domestic violence. there is a $25,000 reward for an arrest in this case.

reporting in east oakland abc 7 news. >> thank you. and some bay area men are being called heroes for coming to the aid of an american airlines pilot attacked aboard an sfo board-bound plane last night. police say the two punched a pilot after being ordered off a flight from miami. one reportedly threatened to have the pilot killed. witnesses say the brothers appeared drunk or maybe, drugged. >> there was a scuffle taking place. so about three, four of us went out there and tackled the guy. and i guess the pilot ended up with some contusions on his face and so we just about what -- did what we needed to do to help out. >> they held two men down 10 minutes until authorities arrived and took them into custody. the woman accused of burglarizing a san francisco hotel room of alex trebek appeared in court today.

and is accused of breaking into the room tuesday morning and stealing cash and jewelry. trebez his wife were in the room at the time. he injured his achilles heel while trying to chase her downs. moyers says she was in the wrong place at the wrong time. >> i haven't done this. i haven't done nothing. i'm sitting here, i haven't done nothing. i haven't gone in his room or nothing. just like i said that night i wasn't in your room. i stick by that. i wasn't in the room. i just knocked on the door. >> in court today a judge ordered moyers to stay 150 yards away from the game show host and his wife. moyers has two previous convictions and this could be a third strike for her. >> those frr 1990 and 1991. both incidents here in san francisco. and she was convicted of the charges and did serve time in state prison for both of the offenses. >> she's being held on $625,000 bail.

trebek schedule forward surgery tomorrow. >> and the people pushing for a ban on male circumcision in san francisco say there is a good chance they'll appeal a judge's decision. the judge ruled their initiative cannot be put on the ballot because it violates state law. and explaining what happened in court today. >> we were the only camera allowed in the courtroom this morning. it was packed with people on both sides of the controversy. the judge made it clear she would not listen to arguments about circumcision itself but strictly, the legal issue. before the hearing, demonstrators tried to sway the court of public opinion. they call themselves inactivists meaning they believe again talls of baby boys should be left intact no. circumcision before age 18. >> once you see circumcision for what it is, it's wrong. >> in court their attorney defending the proposed ballot measure, urnling voters to ban the procedure. >> in this city and county of san francisco, one of the

when line 132 was rerouted a bit to accommodate the new housing development. the cpuc wants to trook at the line as part of its investigation into the explosion along a segment of the replacement pipe. an eight-foot section will be cut on glenn view and handed over to cpuc. there will be another ef caveation point 250 feet southwest, just feet from the rupture site this, is so a camera can inspect the inside of the length of a a.band oned pipe. >> it's putting the camera in one end, and receive it at another end. >> the ntsb says the rupture started on one of the poorly done welds. pg&e records had shown a seamless steel pipe. the ntsb is expected to issue a report on the probable cause in about a month. the explosion and resulting fire killed eight people, destroying 38 homes. bob pelligrini's house was one of them, now, it's well on the

the republican debt deal stalled in the house, it now appears speaker john boehner does not have enough support to get the plan bass pased. boehner postponed a vote plan forward late today and there has been no word on when he might reschedule it. >> from the outset this is going to be a show vote. the house republican measure

police nearly two hours last night. authorities chased them from newark to san joaquin county thinking they were suspects wanted in connection with two murders in east palo alto. it turns out they were not the right people but the car they were driving does belong to one of the murder suspects. both men have been charged with evading police and one charged with carrying a loaded gun. but there is no word so far on why they were driving that car in the first place or what their connection might be to the murder autos federal and state officials are working on what could be the largest marijuana eradication effort in california history. our media partner california watch allowed to shoot this video, part of operation full court press being conducted. so far, local, state and federal agents removed 373,000 pot plants arc resting 88 people. the operation is scheduled to end next week. tomorrow night here on abc 7 news at 6:00 we'll bring you
